DataCC / eSlup™ Terms of Use
These Terms of Use (“Terms”) govern access to and use of DataCC, eSlup™, Ask Lúsa™, DataCC.com, and related websites, applications, features, information, and services provided by CantonWay Group, LLC (“CantonWay,” “DataCC,” “eSlup,” “we,” “us,” or “our”).
By creating an account, purchasing or beginning a subscription or trial, accessing eSlup, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The eSlup Service
eSlup is a market-intelligence and information platform designed to help users organize, view, monitor, analyze, and better understand market-related information.
Features may include customer boards, watchlists, market signals, analytics, educational information, artificial-intelligence-assisted features including Ask Lúsa, account-management functions, and other tools made available from time to time.
We may add, modify, suspend, replace, or discontinue features as the service develops. We do not guarantee that every feature will remain available indefinitely or operate in exactly the same manner in future versions.
2. Eligibility and Customer Accounts
You must be legally capable of entering into a binding agreement in the jurisdiction where you reside to create and use an eSlup account.
You agree to provide reasonably accurate and current information when establishing or maintaining an account. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account. You should promptly notify DataCC if you believe your account has been accessed or used without authorization.
You may not impersonate another person, misrepresent your identity, obtain unauthorized access to another customer's account, or use eSlup for fraudulent or unlawful purposes.
3. Market Information and Third-Party Data
eSlup may display, organize, analyze, summarize, reference, or otherwise use market-related information obtained from third-party sources.
Market prices, quotations, statistics, news, indicators, signals, calculations, analytics, and other information may be delayed, incomplete, inaccurate, unavailable, or affected by technical, market, provider, transmission, or other conditions beyond DataCC's control.
DataCC does not guarantee the accuracy, completeness, sequence, timeliness, availability, or suitability of market information or third-party data.
Market information presented through eSlup should be independently verified when accuracy or timing is important to a user's decision. Third-party information remains subject to applicable ownership, licensing, attribution, and usage restrictions imposed by its respective providers.
4. Not Investment or Financial Advice
eSlup is an information and market-intelligence service. It is not an investment adviser, broker, dealer, financial planner, fiduciary, or trading service.
Nothing presented through eSlup, DataCC, Ask Lúsa, customer boards, market signals, analytics, educational materials, or other features constitutes or should be interpreted as personalized investment, financial, securities, trading, legal, accounting, or tax advice.
References to securities, companies, funds, cryptocurrencies, market conditions, investment strategies, or other financial subjects are provided for informational and educational purposes. DataCC does not direct users to buy, sell, hold, trade, or otherwise transact in any security or financial instrument.
All investment and trading decisions are made independently by the user. Investing and trading involve risk, including the possible loss of principal. Past performance, historical information, market signals, hypothetical results, projections, or analytical observations do not guarantee future results.
Users should obtain advice from appropriately qualified professionals when professional advice is required.
5. Ask Lúsa™ and Artificial Intelligence
Ask Lúsa and other eSlup features may use artificial intelligence and third-party AI technology to generate explanations, summaries, analyses, responses, or other information.
Artificial-intelligence output is generated automatically and may contain errors, omissions, inaccuracies, outdated information, misinterpretations, or other limitations.
AI-generated information must not be treated as a guarantee, prediction, professional recommendation, or substitute for the user's own judgment and independent verification.
Ask Lúsa does not independently execute trades, control a customer's brokerage account, or make investment decisions on behalf of the customer. Users are responsible for evaluating information produced by Ask Lúsa before relying upon it.
Users should not submit passwords, complete payment-card information, Social Security numbers, financial-account credentials, or other highly sensitive personal information through Ask Lúsa.
6. Customer Boards, Signals and Analytics
Boards, indicators, signals, alerts, classifications, calculations, analytics, heat measurements, rankings, summaries, or similar eSlup features are tools for organizing and interpreting information.
They are not promises that a market event will occur and do not guarantee that a particular security, market, strategy, or investment will increase or decrease in value. Users remain responsible for determining how, whether, and for what purpose they use information displayed through these features.
7. Trials, Subscriptions and Billing
eSlup may offer free trials, paid subscriptions, promotional access, gift access, or other plans.
The duration, price, features, and billing frequency applicable to a particular plan will be presented when the customer enrolls or purchases access.
Where a subscription is designated as automatically renewing, the customer authorizes the applicable payment method to be charged according to the selected billing cycle until future renewal is canceled.
Customers may cancel future renewal in accordance with the account-management options made available by DataCC. Unless otherwise stated for a particular offer, cancellation of future renewal does not terminate access already paid for; access ordinarily continues through the applicable paid-through date.
A free trial does not guarantee continued free access after the stated trial period.
DataCC may change future subscription prices or plan features. Where appropriate or required, customers will receive notice before a changed recurring price becomes applicable to a subsequent billing period.
Payments may be processed through third-party payment providers. DataCC does not control the independent operation of those providers.
8. Refunds
Except where otherwise stated at the time of purchase or required by applicable law, payments for periods of service already provided are not automatically refundable.
Any refund approved by DataCC may depend upon the circumstances of the transaction, applicable plan terms, payment-provider requirements, and applicable law.
Nothing in these Terms eliminates refund or cancellation rights that cannot legally be waived in a customer's jurisdiction.
9. Acceptable Use
You may use eSlup only for lawful purposes and in accordance with these Terms.
You may not attempt to gain unauthorized access to the service or another user's account; interfere with the operation or security of eSlup; introduce malicious software; circumvent access, subscription, security, or usage restrictions; use automated methods to overload, scrape, copy, extract, or abuse the service except where expressly authorized; reverse engineer protected portions of the service except where such restriction is prohibited by applicable law; use eSlup to violate another person's rights; or use DataCC's intellectual property in an unauthorized manner.
DataCC may take reasonable action to protect the service, customers, intellectual property, third-party providers, and system security.
10. Ownership and Intellectual Property
Except for information or materials owned by customers or third parties, eSlup and its original software, interface, design, organization, documentation, branding, features, graphics, content, and related intellectual property are owned by or licensed to CantonWay Group, LLC.
DataCC, eSlup™, Ask Lúsa™, associated logos, branding, and other proprietary identifiers may not be copied, represented as another party's property, or used in a manner that falsely suggests sponsorship, affiliation, or authorization.
These Terms provide customers a limited right to use eSlup for its intended purpose during authorized access. They do not transfer ownership of DataCC's intellectual property to the customer.
11. Third-Party Services
eSlup may interact with, display information from, link to, or rely upon third-party services and technologies.
Those services may have their own terms, privacy policies, availability, licensing restrictions, and technical limitations. DataCC does not control and cannot guarantee the continued operation, accuracy, security, policies, or availability of independently operated third-party services.
The modification, interruption, restriction, or discontinuation of a third-party service may affect features within eSlup without creating liability for circumstances outside DataCC's reasonable control.
12. Service Availability and Changes
We work to maintain eSlup as a useful and reliable service, but uninterrupted operation cannot be guaranteed.
The service may occasionally be unavailable because of maintenance, upgrades, technical failures, internet or hosting problems, third-party outages, security events, market-data interruptions, circumstances beyond our reasonable control, or changes necessary to maintain or improve the service.
DataCC may modify, suspend, replace, or discontinue the service or any feature as technology, customer needs, legal requirements, provider relationships, and business conditions change. DataCC may also cease offering eSlup or discontinue business operations, subject to applicable law and any obligations that cannot lawfully be waived.
13. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, eSlup AND ITS INFORMATION, FEATURES, AI OUTPUT, MARKET INFORMATION, ANALYTICS, SOFTWARE, AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
CANTONWAY GROUP, LLC MAKES NO GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT INFORMATION PRESENTED THROUGH THE SERVICE WILL ALWAYS BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR A PARTICULAR PURPOSE.
NO INFORMATION PROVIDED THROUGH eSlup CREATES A GUARANTEE OF INVESTMENT PERFORMANCE, TRADING RESULTS, PROFITS, LOSS PREVENTION, OR ANY PARTICULAR FINANCIAL OUTCOME.
Some jurisdictions do not permit certain warranty exclusions, in which case those exclusions apply only to the maximum extent permitted by applicable law.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CANTONWAY GROUP, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF OR INABILITY TO USE eSlup.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSSES ARISING FROM RELIANCE UPON MARKET INFORMATION, AI-GENERATED OUTPUT, SIGNALS, ANALYTICS, THIRD-PARTY INFORMATION OR SERVICES, SERVICE INTERRUPTIONS, DATA ERRORS, OR INVESTMENT OR TRADING DECISIONS MADE BY A USER.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
15. Suspension, Cancellation and Termination
Customers may discontinue use of eSlup and may cancel future subscription renewal through available account-management procedures.
DataCC may suspend, restrict, or terminate an individual customer's access where reasonably necessary because of nonpayment, fraud, misuse, security concerns, violation of these Terms, unlawful activity, material interference with the service, or protection of DataCC, its customers, or third-party providers.
DataCC may also discontinue a plan, feature, service, or eSlup itself, or cease doing business, subject to applicable law and any non-waivable obligations. Where reasonably practicable, DataCC may provide notice concerning a material discontinuation.
Termination or expiration does not eliminate obligations or provisions that by their nature should reasonably survive termination, including provisions concerning intellectual property, disclaimers, liability, and disputes.
16. International Use
eSlup may be accessible from countries outside the United States.
CantonWay Group, LLC operates from the United States, but users are responsible for ensuring that their use of eSlup is lawful where they access the service.
Certain features, information, pricing, payment methods, or services may not be available in every jurisdiction.
Nothing in these Terms is intended to waive mandatory consumer protections or other legal rights that cannot lawfully be waived in the jurisdiction applicable to a customer. If a provision of these Terms conflicts with a mandatory local-law requirement that cannot legally be excluded, the mandatory requirement will apply to the extent of that conflict.
17. Changes to These Terms
We may revise these Terms as eSlup, our business, technology, providers, or applicable requirements change.
The current version will be made available through DataCC/eSlup and will display its effective date. Where a material change requires additional notice or consent under applicable law, we will provide such notice or obtain such consent as required.
Continued use after an effective change constitutes acceptance of the revised Terms to the extent permitted by applicable law.
18. Governing Law and Disputes
These Terms and the relationship between the user and CantonWay Group, LLC are governed by applicable United States law and the law of the state in which CantonWay Group, LLC is organized, without regard to conflict-of-law principles, except to the extent mandatory law in a user's jurisdiction provides otherwise.
Before beginning formal proceedings, a user is encouraged to bring a dispute to DataCC's attention at support@datacc.com so the parties have a reasonable opportunity to attempt to resolve the matter informally.
Users outside the United States may have mandatory consumer or other legal rights in their country or region. Nothing in these Terms is intended to eliminate rights that cannot lawfully be waived.
19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent reasonably necessary and permitted by law, and the remaining provisions will continue in effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly applicable to a particular eSlup plan, purchase, promotion, or feature, constitute the agreement governing the customer's use of the service.
